1. Agreement

By booking or renting a vehicle from Baraka Car Rentals ("we", "us", "our"), you agree to be bound by these Terms and Conditions. These terms apply to all rental agreements, whether booked online, by phone, or in person. Please read them carefully before confirming your booking.

2. Eligibility

You must hold a valid Australian full licence to rent a vehicle
You must hold a valid, full Australian full licence (or a valid Australian full licence with an official English translation)
You must provide valid identification and proof of address at the time of vehicle collection
Provisional (P-plate) licence holders may be subject to additional conditions

3. Rental Period & Pricing

Rental periods are calculated on a weekly or daily basis as agreed at the time of booking
Pricing starts from $240/week and varies depending on the vehicle selected
There are no lock-in contracts — you may end your rental with reasonable notice
Late returns may incur additional charges at the applicable daily rate
All prices are in Australian dollars and include GST

4. Vehicle Use

Our vehicles may be used for:

Personal use within Victoria
Rideshare driving (Uber, DiDi, and other approved platforms)
Delivery services (Uber Eats and approved delivery platforms)

Our vehicles must not be used for:

Racing, off-road driving, or any illegal purpose
Towing other vehicles or trailers
Driving outside Victoria without prior written consent
Sub-letting or allowing unauthorised persons to drive the vehicle

5. Insurance & Liability

Comprehensive insurance is included in your rental. However, you are responsible for any damage resulting from negligence, misuse, or breach of these terms. An excess may apply in the event of an accident or insurance claim. You must report any accident, damage, or theft to us immediately.

6. Vehicle Condition & Maintenance

Vehicles are provided in clean, roadworthy condition with a full tank of fuel
You must return the vehicle in the same condition, with a full fuel tank
Routine maintenance and servicing are our responsibility during the rental period
You must notify us promptly of any mechanical issues or warning lights
Interior cleaning fees may apply if the vehicle is returned in an unreasonably dirty condition

7. Tolls, Fines & Infringements

You are responsible for all toll charges, traffic fines, parking infringements, and any other penalties incurred during the rental period. An administration fee may apply for processing infringement notices.

8. Cancellation & Refunds

Cancellations made more than 48 hours before the scheduled pickup are eligible for a full refund. Cancellations within 48 hours may be subject to a cancellation fee. Refunds are processed within 5–10 business days.

9. Limitation of Liability

To the maximum extent permitted by law, Baraka Car Rentals is not liable for any indirect, incidental, or consequential damages arising from the use of our vehicles or services. Our total liability is limited to the rental fees paid for the relevant booking period.

10. Governing Law

These Terms and Conditions are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
