Terms and Conditions

1. Rental Agreement

These Terms and Conditions, together with the Rental Agreement provided at the time of rental, constitute the entire agreement between the customer ("You") and BarakaRentals Pty Ltd ("We", "Us", "Our") regarding the rental of vehicles.

By making a reservation or renting a vehicle from Us, You acknowledge that You have read, understood, and agree to be bound by these Terms and Conditions.

2. Reservations and Cancellations

2.1 Reservations

Reservations can be made online, by phone, or in person at any of Our locations. A valid credit card is required to secure a reservation.

2.2 Cancellations

Cancellations made at least 48 hours before the scheduled pickup time will receive a full refund of any prepaid amounts. Cancellations made less than 48 hours before the scheduled pickup time may be subject to a cancellation fee equivalent to one day's rental charge.

2.3 No-Shows

If You fail to pick up the vehicle at the scheduled time without prior notification, We reserve the right to cancel the reservation after a 2-hour waiting period and charge a no-show fee equivalent to one day's rental charge.

3. Driver Requirements

3.1 License Requirements

All drivers must possess a valid driver's license that has been held for at least 12 months. International visitors must have a valid driver's license from their country of residence, accompanied by an International Driving Permit if the original license is not in English.

3.2 Age Requirements

The minimum age to rent a vehicle is 21 years. Drivers under 25 years may be subject to a young driver surcharge and may be restricted from renting certain vehicle categories.

3.3 Additional Drivers

Additional drivers must meet the same requirements as the primary driver and must be present at the time of rental to sign the Rental Agreement. An additional driver fee may apply.

4. Vehicle Pickup and Return

4.1 Pickup Procedure

At the time of pickup, You must present a valid driver's license, a credit card in the renter's name, and any other documentation specified in the reservation. We reserve the right to refuse rental if these requirements are not met.

4.2 Vehicle Inspection

You are responsible for inspecting the vehicle before departure and reporting any existing damage. Any damage not reported at the time of pickup may be considered as having occurred during Your rental period.

4.3 Return Procedure

The vehicle must be returned to the agreed location on the date and time specified in the Rental Agreement. The vehicle should be returned in the same condition as received, except for normal wear and tear.

4.4 Late Returns

Late returns may incur additional charges. A grace period of 30 minutes is provided, after which an additional day's rental may be charged. If You anticipate a late return, please contact Us as soon as possible.

5. Payment and Charges

5.1 Payment Methods

We accept major credit cards including Visa, MasterCard, and American Express. The credit card used must be in the name of the primary renter. Debit cards may be accepted at certain locations with additional verification.

5.2 Security Deposit

A security deposit will be authorized on Your credit card at the time of rental. The amount varies depending on the vehicle category and rental duration. This authorization is not a charge but a hold on available funds.

5.3 Additional Charges

Additional charges may include but are not limited to: fuel (if the vehicle is not returned with the same fuel level as at pickup), late return fees, cleaning fees (if the vehicle requires excessive cleaning), traffic or parking fines incurred during the rental period, and damage repair costs not covered by insurance.

6. Insurance and Liability

6.1 Basic Coverage

All rentals include basic insurance coverage with a specified excess/deductible amount. This coverage typically includes Collision Damage Waiver (CDW) and Theft Protection (TP).

6.2 Additional Coverage

Optional insurance upgrades are available for purchase, including Super CDW (reduces or eliminates the excess), Personal Accident Insurance, and Roadside Assistance coverage.

6.3 Exclusions

Insurance coverage does not apply to damage resulting from: prohibited use of the vehicle, use by an unauthorized driver, driving under the influence of alcohol or drugs, negligence, or violation of traffic laws.

7. Vehicle Use Restrictions

The vehicle must not be used:

• For any illegal purpose or in violation of applicable laws
• To transport goods in violation of customs regulations
• To transport more passengers than the vehicle is designed to carry
• To tow or push any vehicle, trailer, or other object without Our express permission
• Off-road or on unsealed roads unless specifically authorized
• By any person under the influence of alcohol or drugs
• By any person not listed as an authorized driver on the Rental Agreement

8. Accidents and Breakdowns

8.1 Accidents

In the event of an accident, You must: ensure the safety of all persons involved, notify the police if required by law, obtain the details of all parties involved, not admit liability, and contact Us as soon as possible. An accident report form must be completed and returned to Us.

8.2 Breakdowns

In the event of a breakdown, contact Our emergency assistance number provided in the vehicle. Do not authorize repairs without Our prior approval. We will arrange for assistance and, if necessary, a replacement vehicle.

9. Privacy Policy

We collect and use Your personal information in accordance with Our Privacy Policy, which is available on Our website or upon request. By entering into a Rental Agreement, You consent to the collection, use, and disclosure of Your personal information as described in the Privacy Policy.

10. Governing Law

These Terms and Conditions and the Rental Agreement are governed by the laws of the state or territory in which the rental commences. Any disputes arising from the rental shall be subject to the exclusive jurisdiction of the courts in that state or territory.

11. Modifications

We reserve the right to modify these Terms and Conditions at any time. Any modifications will be effective immediately upon posting on Our website. Your continued use of Our services after any such changes constitutes Your acceptance of the new Terms and Conditions.
